Information on the processing of personal data

The Controller complies with the rules and principles of personal data protection, in particular the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing the Directive 95/46/EC (hereinafter: ‘GDPR’).

 

In order to fulfil the obligations specified in Articles 13 and 14 of the GDPR, the Controller presents this information on the processing of personal data.

 

  1. Personal Data Controller

The Controller of your personal data is VIX AUTOMATION Sp. z o.o., with its registered office in Katowice at ul. Żeliwna 43, 40-852 Katowice, KRS (National Court Register number): 0000247380, REGON (Business identification number): 240214146, NIP (Tax identification number): 9542531885 (hereinafter referred to as: ‘the Company’).

  1. Personal data

Your personal data may be processed for the purpose of maintaining business contacts, performing an agreement concluded with you or your employer (cooperating entity) who has designated you as a contact person, performing an agreement concluded with the entity you represent, and in order to fulfil the Controller’s legal obligation as a tax payer and an economic entity (including for the purpose of reporting) and pursuing a legitimate interest of the Controller, in particular establishing, pursuing or defending claims.

 

  1. Legal basis for the processing of personal data

The legal basis for the processing of your data is the necessity to perform the contract and to fulfil the legal obligation imposed on the Controller, as well as the fulfilment of the Controller’s legitimate interest, as specified in item 2 above.

 

  1. Processing period and source of data

We do not store your data for longer than necessary. The current provisions justify the application of a five-year retention period starting from the end of the calendar year in which the contract expired.

 

If you are the representatives of the Parties to the agreement, we have received your data directly in the course of discussions concerning the agreement. As regards the name, surname and function performed, we could also obtain it from the public register – the National Court Register.

 

If you have been designated as contact persons for the agreement, the source of personal data is our contractor and your employer or the entity to whom you provide services on the basis of a contract other than employment relationship.

 

Basic personal data such as first name, surname, business e-mail address, business telephone number, position could have been obtained from our contractor or from public registers or other publicly available sources. In some cases, we will also process information concerning the identification number (NIP, REGON), business addresses of the business activity. Other data will be processed as long as we are provided with them e.g. in the course of exchanging correspondence.

 

  1. Rights of data subjects

All persons whose data are subject to processing by the Controller are entitled to:

  1. access to the content of the data, obtain their copies, rectify and transfer them;
  2. request restriction of processing in cases specified in the GDPR;
  3. object to the use of personal data at any time;
  4. withdraw consent to the processing of data (if the processing took place on the basis of the consent), and the withdrawal does not affect the lawfulness of processing based on the consent before its withdrawal;
  5. obtain information on the purposes of processing, categories of personal data processed, recipients or categories of recipients of such data, the planned period of data storage or the criteria for determining the period;
  6. delete the data in cases specified in the GDPR;
  7. lodge a complaint with the President of the Personal Data Protection Office when you believe that the processing of your personal data violates the provisions concerning the protection of personal data.

 

  1. Other information

Only authorised employees and co-workers of the Controller shall have access to your personal data. In certain situations, your personal data may be disclosed by the Controller to entities related to the Controller and other recipients, such as providers of IT services and solutions for the Controller.

 

In principle, your data will not be transferred to recipients located in countries outside the European Economic Area (the so-called third countries). In some cases, if you are designated as contact persons in connection with a purchased license, your data may be made available to General Electric Company or its subsidiaries. The availability of your data is necessary to conclude an agreement between your employer and General Electric Company in the scope of granting the license.
